TERMS AND CONDITIONS
1. INTRODUCTION.These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.
2. PRODUCT PRICING AND TITLE. We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at any time up to the electronic shipment of that order and any related items.
We reserve the right to alter all product pricing without notice.
3. PAYMENT.Fees are payable in advance before the first day of each billing cycle. Customer’s billing SUBSCRIPTION cycle shall be yearly as indicated on the order. VacationRentalDesigns will require payment for the renewal at least 2 days before the bill cycle is due for renovation. Invoiced fees may be issued on or before the 1st day of each billing cycle, and the fees shall be due on the 14th day following invoice date, but in no event later than 14 days after each billing cycle. We reserve the right to suspend accounts not paid on time.
4. REGISTRATION. You warrant that:
The personal information which you are required to provide when you register is true, accurate, current and complete in all respects;
4.1. you are not impersonating any other person or entity and
4.2. you will notify us immediately of any changes to your personal information by emailing us.
5. TRANSACTION CONDITIONS. Sale and Order Terms:
Orders will only be accepted from persons over the age of 18. All prices are inclusive of TAXES (where applicable) at the current rates and are correct at the time of entering the information onto the system. When you place an order you will receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order. Your offer is only accepted by us once we have emailed you to confirm acceptance. We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account. In the unlikely event of there being such an increase in the price of goods or services you, the buyer, shall be entitled to cancel the order at any time before delivery. By placing an order, you, the buyer, consent to payment being charged to your credit card account or electronic payment account as provided on the order form.
6. ELIGIBILITY. To be eligible to purchase goods or services on this Website and lawfully enter into and form contracts on this Website, you must:
6.1 if an individual, be 18 years of age or over; and
6.2 register your real name, address, phone number, email address and any other details requested.
7. CANCELLATION RIGHTS AND REFUNDS. You may cancel your account within 30 days of payment and will receive a full refund excluding any fees paid for domain registration. We will remove all user generated content from public view and transfer your domain name into an account in your name. You do not have the right to reproduce any part of the website design or associated code once the contract is terminated.
8. EARLY TERMINATION. The amount of the fee for the service is based on agreement to pay the fee for the entire Initial Term, or Renewal Term, as applicable. In the event VacationRentalDesigns.com terminates the Agreement for users Breaches of these terms and conditions in accordance with Section 9 (Termination), or Customer terminates the service other than in accordance with Section 9 (Termination) no fees or portion of fees will be returned.
9. DOMAIN NAME. If we register a Domain Name on your behalf, you remain the legal owner at all times and can transfer it to you own account at any time except within the first 65 days of from registration. Once in your own account you are liable for all fee and future renewals.
10.SITE UPTIME. We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do so metimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.
This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.
11. VARIATION. We may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of our website from the date of the publication of the revised terms and conditions on our website. 15. ENTIRE AGREEMENT. These terms and conditions, together with our privacy policy and the End User License Agreement constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.
16. LAW AND JURISDICTION.These terms and conditions will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
